Terms of Service

Last Updated: October 24, 2026

Welcome to the website of PerformanceMech Heating & Air ("PerformanceMech," "we," "us," or "our"), accessible at https://performancemech.link. By accessing or using this website, or by placing telephone calls to our published dispatch numbers to request heating, ventilation, or air conditioning services, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please discontinue using this website and our communication channels.

1. Service Scope and Geographic Limitations

PerformanceMech Heating & Air provides residential and light commercial heating, air conditioning, heat pump, ductless mini-split, and indoor air quality services. Our active operating territory is strictly focused within a 25-minute radius centered around our Campbell, California service hub (900 E Hamilton Ave, Suite 150, Campbell, CA 95008).

Primary served jurisdictions include Campbell, Los Gatos, Monte Sereno, Saratoga, West and South San Jose, Cupertino, Santa Clara, Sunnyvale, Mountain View, and Los Altos. Service inquiries originating outside our verified operating territory may be declined or referred to regional providers at our operational discretion.

2. Scheduling, Dispatch, and Arrival Windows

All service requests, diagnostic visits, and emergency dispatches are scheduled via telephone consultation. While we make every reasonable commercial effort to meet estimated arrival windows, stated response times—including same-day emergency windows—are dependent upon traffic conditions, severe weather events, technician safety, and active emergency volume across the South Bay. We will communicate schedule adjustments promptly whenever field conditions require changes.

3. Diagnostic Evaluations and Written Work Authorizations

A professional diagnostic assessment is required prior to performing mechanical repairs or system replacements. Upon completing the initial inspection of your furnace, condenser, heat pump, or ductwork, our technician will provide a clear, itemized explanation of findings and a written estimate detailing required labor, replacement components, and testing.

No non-emergency mechanical repairs or equipment replacements will proceed without explicit homeowner authorization. Diagnostic inspection fees apply to on-site visits and will be clearly communicated during initial phone dispatch triage.

4. Permits, HERS Testing, and California Title 24 Compliance

Major heating and cooling equipment replacements—including central split AC systems, heat pumps, and gas furnaces—are subject to California Building Standards Code (Title 24, Part 6) and municipal permitting regulations enforced by the City of Campbell, City of San Jose, and surrounding municipal building departments.

Our installation proposals incorporate required permit filings and independent third-party Home Energy Rating System (HERS) verification testing (including duct leakage verification and refrigerant charge tests) where mandated by law. The homeowner agrees to provide necessary access to premises for city inspectors and certified HERS raters to achieve final permit sign-off.

5. Intellectual Property

All original text, technical diagrams, graphics, logos, images, code, and content published on this website are the intellectual property of PerformanceMech Heating & Air and are protected under United States copyright, trademark, and intellectual property laws. Unauthorized reproduction, modification, distribution, or automated scraping of our content without prior written permission is strictly prohibited.

6. Website Disclaimers and Informational Content

The articles, troubleshooting checklists, and rebate summaries published on our website and blog are provided solely for general informational purposes. While we strive to maintain accurate, up-to-date information regarding local utility rebate programs (such as SVCE and Silicon Valley Power) and air district regulations (such as BAAQMD Rule 9-4), utility rebate qualifications and municipal regulations are subject to administrative change. Informational content on this site does not constitute formal engineering advice or an official contractual rebate guarantee.

7. Limitation of Liability

To the fullest extent permitted by California law, PerformanceMech Heating & Air, its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to access this website, or from delays in technician arrival caused by severe weather, regional road closures, or power outages.

8. Governing Law and Dispute Resolution

These Terms of Service and any contractual agreements entered into through our services shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any legal dispute or proceeding arising out of or related to these terms or our services shall be instituted exclusively in the state or federal courts situated in Santa Clara County, California.
